Terms of Use
Terms that govern your use of the middlethings.co website. Separate from the sale terms (CGV / Terms of Service) that apply when you place an order on our online store.
1. Acceptance
By accessing middlethings.co, you agree to these Terms of Use. If you don't agree, please don't use the site. We may update these terms from time to time; continued use after a change means you accept the new version.
2. Scope
These terms cover use of the marketing website at middlethings.co only. Purchases are governed by the separate Terms of Service published on our online store at store.middlethings.co/policies/terms-of-service, which take precedence for any order-related question.
3. Acceptable use
You agree not to use the website to:
- Probe, scan, or test the vulnerability of any system or breach security or authentication measures.
- Send unsolicited bulk messages through any of our contact forms.
- Scrape, mine, or otherwise extract content for republication without our written consent (the Press Kit explicitly authorises certain editorial uses — read it first).
- Reverse-engineer, decompile, or attempt to extract the source code of any software we distribute (e.g. Middle Control), except to the extent that such restriction is prohibited by mandatory law.
- Misrepresent your identity, your company, or your affiliation with Middle Things or a third party.
4. Our content
All website content — text, photography, packshots, product designs, interface screenshots, illustrations, logos, and the overall visual identity — belongs to Middle Things SAS, with rights reserved. The Press Kit grants a specific licence for editorial and reseller uses; everything outside that licence requires our prior written consent.
Third-party trademarks (DJI, Blackmagic Design, ATEM, Neutrik, Sony, Canon, Bitfocus Companion, Stream Deck, Behringer, MakePro Glue, etc.) are mentioned for compatibility and reference. Their rights belong to their respective owners.
5. Anything you send us
If you send us suggestions, ideas, feedback, or other contributions (by email, contact form, social media), you grant us a non-exclusive, royalty-free, worldwide, perpetual licence to use that contribution for any business purpose, without any obligation of compensation or attribution. We promise to use that licence reasonably — e.g. to fix a bug you reported or to improve a product based on your feedback.
6. External links
The website includes links to third-party sites (online docs, store, partners, social media, reseller directories). We don't control those sites and aren't responsible for their content, privacy practices, or availability.
7. Availability
We work hard to keep the website fast and online but we don't guarantee uninterrupted access. We may temporarily restrict availability for maintenance, upgrades, security, or any other reason without prior notice.
8. Disclaimer of warranties
The website is provided "as is" and "as available". To the fullest extent permitted by applicable law, we disclaim all warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. See our separate Disclaimer for the full wording.
Nothing in these terms limits any non-waivable statutory protection that applies to you under French law — including, for consumers, the legal guarantee of conformity (garantie légale de conformité, articles L.217-3 et seq. of the French Consumer Code), and, for all buyers regardless of professional status, the guarantee against hidden defects (garantie des vices cachés) under article 1641 of the French Civil Code.
9. Limitation of liability
To the fullest extent permitted by applicable law, Middle Things SAS shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) the website. This limitation does not apply to damages caused by our gross negligence or wilful misconduct, nor to any liability that cannot be excluded under French law.
10. Governing law and jurisdiction
These terms are governed by French law. We always try to resolve any dispute amicably first — please write to us.
For professional (business) customers, any dispute relating to these Terms of Use that cannot be settled amicably falls under the exclusive jurisdiction of the courts of Paris.
For consumers, that clause does not apply: you keep every protection of the French Consumer Code, you may bring proceedings before the court of your place of residence (or the place of delivery), and you may use the consumer-mediation procedure set out in our Legal Notice.
